Privacy Agreement

1- Personal Data

All information that allows a natural person to be identified is personal data.

For example, a person’s name, surname, telephone number, and educational background are among such personal data.

2- Data Controller

Pursuant to the Law No. 6698 on the Protection of Personal Data (the "Law"), your personal data may be processed by Osteoid Sağlık Teknolojileri A.Ş. (the "Company") within the scope described below.

3- Personal Data Collection Methods and Legal Grounds

Your personal data is collected electronically by the Company via e-mail, contracts, the relevant websites, mobile applications, and the social media accounts that you grant the Company access to.

Your personal data may be processed by the Company within the services it provides as a goods/service provider for the sake of fulfilling legal obligations, for reasons directly related to the establishment and performance of the contract, as required by the laws, as part of the Company’s legitimate interests, and for other cases with the data subject’s explicit consent.

In this context, your personal data may be collected verbally, in writing, or electronically by providing information to the Company during goods/service requests, at the moment the contract is concluded or afterward with your consent, as you create a user account online and save information, or as you submit a request or complaint.

The Company complies with the obligation to take all necessary technical and administrative measures to prevent unlawful processing, to prevent unlawful access, and to ensure the preservation of personal data.

4- Personal Data Processing and Its Purposes

The Company may record, store, update, disclose, transfer, classify, and process your personal information to the extent permitted by law. Collecting, recording, storing, preserving, modifying, restructuring, disclosing, transferring, taking over, making accessible, classifying, or preventing the use of such data, whether partially or entirely automatically or as part of any data recording system, constitutes the processing of personal data.

Your personal data is processed for the following purposes:
•Conduct data mining and other statistical analyses,
•Inform you via e-mail about company announcements and other corporate news related to the Company,
•Inform you via e-mail about new product introductions, special events, and services,
•Send e-mails containing advertising, promotions, introductions, special offers, and campaigns,
•Fulfill our obligations and rights arising from the legislation,
•Carry out advertising, promotion, and similar activities that also cover social media,
•Conduct promotion and announcement activities through social media and allow reminders of liked or frequently revisited content and features,
•Plan and execute actions to increase awareness of the institution, its activities, and the brand.

5- Transfer of Personal Data

Your personal data may be shared with institutions and organizations we cooperate with to carry out Company operations for the purposes listed under Article 3, with domestic and international entities that provide cloud storage services, with domestic and international parties that support our e-newsletter dispatches, with firms that provide infrastructure services for the website and mobile application, with social media platforms, and with authorized public institutions and organizations in accordance with legal obligations.

6- Rights of the Personal Data Owner under Article 11 of the KVKK (the "Law")

Under the KVKK, you may exercise the following rights regarding your personal data:
a) Learn whether your personal data is processed,
b) Request information if it has been processed,
c) Learn the purpose of processing your personal data and whether it is used in accordance with that purpose,
d) Know the third parties or countries where your personal data is transferred,
e) Request correction if your personal data is incomplete or inaccurate,
f) Request deletion or destruction of your personal data under the conditions set forth in Article 7 of the Law,
g) Request that actions taken pursuant to items (e) and (f) be notified to third parties to which personal data has been transferred,
h) Object to a result that occurs against you by solely analyzing your personal data through automated systems,
i) Demand compensation for damages in case you suffer a loss due to unlawful processing of your personal data.

You can submit your requests regarding the rights listed above to our Company. Your requests will be finalized free of charge within 7 business days at the latest, depending on the nature of the request; however, if the transaction requires an additional cost, we may charge you according to the tariff determined by the Personal Data Protection Board.

Consent Statement

I hereby acknowledge that I have been informed by Osteoid Sağlık Teknolojileri A.Ş. about my personal data during the purchase of the software that provides data for patient-specific orthosis production via the AI-supported design program, within the scope of the Law No. 6698 on the Protection of Personal Data (the "Law"), through the User Clarification Text that was prepared.

Consent for Transfer of Data Abroad

I give my explicit consent for the transfer of my personal data abroad when those systems, the databases of the e-mail providers hosting my data, or the partners and service providers abroad that Osteoid works with in areas such as information technologies, marketing/advertising activities, or consultancy services that require expertise are involved and the Company shares data in that context.

Consent for Analysis/Statistics/Marketing Cookies

I give my explicit consent for my personal data to be processed for the purposes of presenting personalized features and offers, creating personalized or general campaigns, advantages, promotions, advertisements, organizing campaigns, competitions, draws, and other events, performing segmentation, profiling, reporting, marketing, and analysis studies, running Osteoid advertisements and communication activities (notifications, pop-ups, personalized offers, customizing user screens, surveys, etc.) on the Mobile Application, the Site, or other third-party environments, and improving the user experience.

Consent for Commercial Messages

In accordance with Law No. 6563 on the Regulation of Electronic Commerce (ETDHK) and without requiring a separate approval (Regulation on Commercial Communication and Commercial Electronic Messages Article 2/2-b), I give my explicit consent for my personal data to be processed for the purpose of benefiting from suitable products, applications, advantages, or campaigns tailored to my needs; for general information, promotion, advertisement, marketing, celebration, and wishes; and for communication via data, voice, and media-rich content that will be sent to my contact information by Osteoid or third parties acting on its behalf, including calls, SMS, MMS, fax, automatic dialing machines, e-mail, and similar channels.

Final Clarification

As explained in the Clarification Text, I have been informed about the categories of processed and stored personal data, the purposes for which they are processed, and the third parties, institutions, and organizations to which they are transferred. I am aware of my rights under Article 11 of the Law in case I change my will.
